SUMMARY: On November 5, 2024, California voters passed Proposition 36, “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reformed multiple laws from Proposition 47, which have been responsible for increased homelessness, drug addiction, and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies can apply during arrests when appropriate. These new charges can carry enhanced sentencing and prevent offenders from being cited and released before their court appearance. The following is an arrest where Proposition 36 is applied:
On Sunday, January 12, 2025, deputies from Twin Peaks Station received a call for service about an suspicious subject walking around residences in the 1200 block of Aleutian Drive, in the Lake Arrowhead community. As deputies searched the area, they located a subject who matched the description of the subject seen walking in the area. Ismael Hinojosa was contacted and found to be on Post-Release Community Supervision through the California Department of Corrections. Hinojosa was detained, and when searched, he was found in possession of a fixed-bladed knife and illegal narcotics.
Hinojosa was arrested and booked into Central Detention Center for Carrying a Concealed Dirk or Dagger, Treatment-Mandated Felony, and a Post-Release Community Supervision violation.
