SUMMARY:
On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:

On Tuesday, January 14, 2025, at approximately 2:24 pm, an employee from Old Navy on State Highway 18 called to report a subject who had stolen merchandise from the store but had left the location. The employee gave San Bernardino County Sheriff’s Dispatch a description of the subject.

At 2:41 pm, dispatch received a call from Ross reporting they also had a subject leave the store without paying for merchandise. The description given by the employee at Ross closely matched the description given by Old Navy.

At 3:35 pm, Target on State Highway 18 also called to report a shoplifting. Employees reported a subject with the same description as the two previous calls had left the store through an emergency exit after opening and consuming alcohol inside the store.

Deputy D. Vallejo, assigned as the Retail Theft Deputy for Apple Valley Police Department was dispatched to investigate these thefts. While on scene speaking with employees from the stores in the area, dispatch received a call of a subject causing a disturbance at Del Taco. This subject also matched the description of the suspect in the shopliftings.
While deputies were responding to Del Taco, employees reported the subject left towards Carl’s Jr. Deputies A. Gonzalez and A. Sanders arrived and contacted the subject outside Carl’s Jr. This subject, identified as Oscar Aguirre, III, was confirmed to be the same suspect in all three shoplifting calls.

Aguirre was subsequently arrested and booked into High Desert Detention Center where he is being held in lieu of $30,000 bail for PC 666.1(a)(1), Petty Theft with Prior Convictions. Aguirre was issued a citation to appear at a later date for the charges of PC 415(2), Unreasonable Noise and PC 647(f), Public Intoxication.

Anyone with any information about this investigation is asked to contact Deputy D. Vallejo or Deputy A. Gonzalez with Apple Valley Sheriff’s Station at (760) 240-7400 or Sheriff’s Dispatch at (760) 956-5001.
