Deputies Respond to an Unknown Disturbance and Locate a Suspect in Possession of a Controlled Substance

INCIDENT: H&S 11395 (B)(1)- Possession of a Controlled Substance with Two Prior Convictions, PC 3056- Violation of Parole
LOCATION: 15700 block of Tokay Street, Victorville
SUSPECT(S): Marcos Lopez, 42-year-old Resident of Victorville
SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On Sunday, January 5, 2025, at approximately 9:13 p.m., deputies from the Victorville Sheriff’s station responded to an unknown disturbance on the 15700 block of Tokay Street. The reporting party stated a male subject, who was later identified as Marcos Lopez, was threatening to burn the house down.
Upon arrival, Lopez was observed running from the house. Deputies set a perimeter and detained Lopez without incident. Lopez was in possession of a controlled substance, and a records check revealed he had several prior convictions for possession of a controlled substance.
Marcos Lopez was arrested and booked at High Desert Detention Center in Adelanto, for H&S 11395 (B)(1)- Possession of a Controlled Substance with Two Prior Convictions, P.C. 3056- Violation of Parole.
