INCIDENT: Possesion of a Controlled Substance with Two or More Prior Convictions and Possession of Paraphernalia
LOCATION: Santa Fe Aven East / Walnut Street, Hesperia
SUSPECT(S): Billy Breazeale, 39-years-old, Transient of Hesperia
SUMMARY:
On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On January 15, 2025, at approximately 12:40 p.m., Deputy Je. Sanchez with the Hesperia Police Department contacted the suspect, identified as Billy Breazeale, in the area of Santa Fe Ave East / Walnut Street in the city of Hesperia. During the contact with Breazeale, Deputy Je. Sanchez located drug paraphernalia. During a records check, Deputy Je. Sanchez discovered Breazeale has numerous convictions for drug related charges.
Breazeale was arrested and booked into the High Desert Detention Center for HS11395(b)(1) – Possession of a Controlled Substance with 2 or More Prior Convictions and HS11364(a)- Possession of Paraphernalia.
