Deputies Respond to a Fire and Locate a Convicted Felon in Possession of Suspected Methamphetamine and Handguns

DATE/TIME: Wednesday, January 23, 2025, at 6:37 a.m.

INCIDENT: HS 11359(B)(1): POSSESSION OF A CONTROLLED SUBSTANCE WITH PRIORS
                   PC 29800(A)(1): FELON IN POSSESSION OF A FIREARM

LOCATION: 9500 Block of Malpaso Road, Phelan

SUSPECT: Samuel Oh, 39 years of age, resident of Phelan


SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:

On Wednesday, January 23, 2025, at 6:37 a.m., deputies responded to the report of a shed on fire at a residence in the 9500 block of Malpaso Road in Phelan. 

An male adult at the scene of the fire provided deputies with a false name. During the investigation, deputies positively identified the subject as 39-year-old Samuel Oh and learned he lived at the residence. During the service of a search warrant at the property, deputies located suspected methamphetamine, drug paraphernalia, and two handguns.

Samuel Oh, who is a convicted felon, was arrested for possession of a controlled substance with priors, felon in possession of a firearm, possession of unlawful paraphernalia and giving false ID to a deputy. He was also arrested for one felony and multiple misdemeanor warrants out of Orange County. He was booked at the High Desert Detention Center.
