SUMMARY:
On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:

On Thursday, January 23, 2025, deputies responded to a residence in the 12000 block of Chamberlaine Way regarding a 21-year-old male adult who overdosed on Fentanyl. The male was located inside a small bumper pull trailer on the property. Deputies administered NARCAN and continued lifesaving efforts until paramedics arrived and transported him to a local hospital.

During the investigation, deputies learned that four young children, between the ages of 6 years old and 10 years old, were sleeping inside the trailer in deplorable conditions. Narcotics and drug paraphernalia were located within close proximity of the children.

All children were removed from the premises and turned over to Child and Family Services after a medical evaluation.

Jonathan Garcia, and the parents of the children, Moriah Amesquita and Jacob Hernandez, were arrested and booked at the High Desert Detention Center. Moriah Amesquita was found in possession of Fentanyl at the time of her booking.

The investigation is ongoing and anyone with information is asked to contact Deputy N. Serna, at Victor Valley Sheriff’s Station 760-552-6800. Callers can remain anonymous and contact We-Tip at 800-78CRIME (27463) or www.wetip.com.
