Rancho Cucamonga Deputies Locate Burglary Suspect and Arrest Him on Numerous Charges

LOCATION: Foothill Blvd. and I-15 Freeway, Rancho Cucamonga
SUSPECT(S): Felipe Gutierrez, Age 43, Resident of Rancho Cucamonga
VICTIM(S): Confidential
SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On January 28, 2025, at 10:01 A.M., Rancho Cucamonga detectives along with investigators from the Rancho Cucamonga Multiple Enforcement Team searched for a burglary suspect near Foothill Blvd. and the I-15 Freeway. Felipe Gutierrez was contacted and detained. Deputies located and recovered stolen merchandise from the burglary. During the investigation, Gutierrez was found to be in possession of suspected methamphetamine and had several prior drug related convictions.
Gutierrez was arrested and booked at Central Detention Center for PC182(A)(1)- Conspiracy to Commit a Crime, PC459-2nd Degree Burglary, PC496(A)- Possession of Stolen Property, PC273.5(A)- Inflict Corporal Injury on Spouse, and HS 11395-Possession of Narcotics/Paraphernalia with Two Prior Convictions. The case has been forwarded to the San Bernardino County District Attorney’s office for review.
