Passenger in Stolen Vehicle Found to be in Possession of PCP, Two Others Arrested for Possession of a Stolen Vehicle

SUSPECT(S): Hector Pelayo, Age 52, resident of Los Angeles
Carlos Lopez, Age 41, resident of Los Angeles
Olga Rogelcruz, Age 31, resident of Los Angeles
VICTIM(S): State of California
SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On February 2, 2025, at 11:18 a.m., deputies located an occupied stolen vehicle in the area of Haven Ave and Foothill Blvd. Hector Pelayo was found to be a passenger in the stolen vehicle. During the investigation, Pelayo attempted to discard a small glass jar containing suspected Phencyclidine (PCP). Pelayo was detained by deputies and found to have several prior drug related convictions.
Pelayo was arrested and booked at West Valley Detention Center for HS 11395-Possession of Narcotics/Paraphernalia with Two Prior Convictions. The driver of the vehicle, Carlos Lopez, and another passenger, Olga Rogelcruz, were arrested for PC 496D(A)- Possession of a Stolen Vehicle and booked at West Valley Detention Center.
