Arrest Made for Possession of a Controlled Substance During a Well Check of Man Passed Out in a Car

DATE/TIME: Thursday, February 6, 2025, at 9:19 a.m.

INCIDENT: H&S 11395(b)(1), Possession of a Controlled Substance with Two Prior Convictions

LOCATION: 600 block of Warren Vista Avenue, Yucca Valley 

SUSPECT(S):  David Gould, 46-years-old, resident of Desert Hot Springs

VICTIM(S): State of California


SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:

On Thursday, February 6, 2025, at approximately 9:19 a.m., San Bernardino County Sheriff’s Department, Morongo Basin Station, deputies responded to a welfare check in the 600 block of Warren Vista Avenue, Yucca Valley, after reports of a male passed out in the driver’s seat of a running vehicle.

Upon arrival, deputies made contact with the individual, later identified as 46-year-old David Gould. During the encounter, deputies observed a glass pipe with suspected drug residue in plain view inside the car. Gould was detained, and a search of the vehicle was conducted. During the search, deputies discovered four clear plastic bags containing suspected methamphetamine. 

Gould  was arrested for H&S 11395(b)(1) - Possession of a controlled substance with two prior convictions, and was transported to the Morongo Basin Jail for booking. The suspected methamphetamine was collected as evidence and submitted for analysis. The case has been forwarded to the District Attorney’s Office for review.
