SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled "The Homelessness, Drug Addiction and Theft Reduction Act." The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:

On Friday, January 31, 2025, at approximately 10:25 p.m. deputies from the San Bernardino County Sheriff's Department, Morongo Basin Station, were dispatched to the Walmart Supercenter in Yucca Valley. The call for service was for a White male adult, later positively identified as Casey Moses, stealing items from the store. Deputies were informed Moses had walked away from the location onto El Dorado Avenue. Deputies conducted an area check on El Dorado Avenue and located a Walmart Supercenter shopping cart and saw Moses run to an open lot located on the east side of the street. Deputies walked to the open lot and saw Moses lying prone on his stomach behind a Joshua Tree. Deputies took Moses into custody and Walmart Supercenter Loss Prevention confirmed the stolen items were in the shopping cart where Moses was located. Deputies conducted a criminal history check on Moses and confirmed Moses had two prior convictions for theft and was eligible for PC 666.1(A)(1), Theft with Two Prior Convictions, which is a felony charge.
