Deputies Arrest Man for Possession of Narcotics after He Threw Meth out the Window During Traffic Stop

SUMMARY:
On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction, and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On April 2, 2025, deputies assigned to the Rancho Cucamonga Sheriff’s Station initiated a traffic stop on a Ford Flex near the intersection of Vineyard Avenue and Arrow Route. The vehicle traveled at slow speeds onto 7th Street where the deputies saw the driver throw two items out of the driver’s window. The vehicle yielded at Vineyard Avenue and 8th Street. Deputies contacted and identified the driver as Mosese Uniseni Toki. Toki and the passenger of the vehicle were detained.
Deputies searched the area where Toki was seen throwing items out of the vehicle and located approximately 136 grams of suspected methamphetamine. Deputies conducted a search of the vehicle and located digital scales, and additional items consistent with the sale of narcotics. Toki has prior convictions for drug-related charges.
Toki was arrested and booked at the West Valley Detention Center for HS11395(b)(1)-Possession of Narcotics with Prior Convictions and HS11378- Possession of a Controlled Substance for Sale.
