SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On Tuesday, April 8, 2025, Deputy Quiroz, the Yucca Valley Traffic Enforcement Officer, was conducting school zone speed enforcement as Yucca Valley High School students were being released for the day. At approximately 2:18 p.m., he observed a Volkswagen Jetta traveling at an unsafe speed through the school zone while children were present.
The driver was issued a citation for the violation. A passenger in the vehicle was identified as Dustin Derue Don Loser, who was found to be on formal felony probation. A search revealed he was in possession of methamphetamine and drug paraphernalia.
Loser was taken into custody for possession of a controlled substance with two or more prior convictions, possession of drug paraphernalia, and two outstanding no-bail felony warrants for probation violations. Loser was booked at the Morongo Basin Jail and later transferred to the West Valley Detention Center, where he is currently being held without bail.
