Press Release: Hate Crime in Violation of Civil Rights

On April 5, 2025 at approximately 2:15 p.m., Fremont PD patrol officers were dispatched to the report of an assault at a fast-food restaurant on the 38000 block of Fremont Blvd. Officers contacted an adult victim inside the restaurant. The victim stated the suspect, later identified as Marcus Harper (22 years old, resident of Union City), approached the table where she was eating with her family, which included two children. Harper initially took food from their table and ate it in front of them. Harper walked away from the table for a brief time before returning to the table to slap the adult victim on her face while standing behind her. Harper then made a disparaging comment about the victim’s perceived race or ethnicity. Harper yelled at the victim and her family, then threw a packet of dipping sauce at the second victim, a child.  Neither victim sustained injuries. Harper left the fast-food restaurant prior to police arrival.  

The Fremont Police Department Crimes Against Persons Unit assumed the investigation, which was determined to be a hate crime. Detectives identified Marcus Harper as the suspect and a warrant was obtained for his arrest. On April 15, 2025 a team of detectives searched for Harper and located him sitting alone in his vehicle in the area of Marshlands Road and Thornton Avenue. Harper was placed under arrest without incident.

On April 16, 2025 the case was presented to the Alameda County District Attorney Office. Harper was charged with Penal Code 422.6(a) – hate crime in violation of civil rights and Penal Code 242 – battery. Harper remains in custody at Santa Rita Jail.
