The San Bernardino County Sheriff's Department announces that a federal jury found in favor of the Department reference the case of Michael Bowman v. County of San Bernardino. The verdict confirms what the evidence clearly demonstrated: Deputy Martinez acted lawfully, reasonably, and professionally during Mr. Bowman's arrest. We are grateful that both the facts and the law prevailed.
On June 14, 2022, at approximately 10:40 a.m., Deputy Martinez responded to a report of a stolen postal van near Del Rosa Road in Phelan. Upon arrival, he encountered Michael Bowman and others at the scene. Due to the ongoing investigation, Deputy Martinez lawfully detained Bowman, who became uncooperative, resisted detention, and struck the deputy.
Deputy Martinez appropriately responded by using reasonable force to gain control of the situation and ensure the safety of everyone present. Following the incident, Bowman filed a federal lawsuit alleging excessive force, false arrest, negligence, and civil rights violations against the County, the Sheriff's Department, and Deputy Martinez.
On March 25, 2025, the jury returned a defense verdict in favor of the Sheriff's Department and Deputy Martinez, finding no wrongdoing and affirming that the actions taken were justified.
