Bear Valley CSD Gate Operations

The Bear Valley Community Services District (CSD) has important clarifications regarding gate operations and public access to roads in Bear Valley Springs.

According to the 1973 Bear Valley Specific Plan, roads within Bear Valley Springs are designated as “semi-public”. Section 7.f.(1) of the Covenants and Restrictions limits access to common areas to homeowners, homeowners’ families, invitees, guests, tenants, District and Association employees, as well as employees and agents of homeowners.

On March 2, 2006, the BVCSD Board passed Resolution 06-1205, formally stating that the intent of maintaining a gated entrance is to restrict access to landowners, residents, and authorized visitors in the interest of public safety. Furthermore, according to District Code 4-1-3, entry through the gate is limited to individuals who have been issued a gate permit.

There are, however, exceptions to that rule. Any member of the public is permitted to enter with a legitimate reason to use district roads. Examples of legitimate reasons include:

• Attending services at Bear Valley Church
• Attending BVCSD Board or Committee meetings
• Visiting the Bear Valley cemetery
• Shopping at the Bear Valley Market or using the gas station

In short, except for certain situations previously outlined, a gate permit is required to enter Bear Valley Springs.
