Twentynine Palms Man Arrested for Possession of a Controlled Substance with Prior Convictions

INCIDENT: Health and Safety Code 11395(b)(1): Possession of a Controlled Substance with Two Prior Convictions
LOCATION: Bermuda Avenue and Twentynine Palms Highway, Twentynine Palms
SUSPECT(S): Drake Arthur Tyerman, 66 year old resident of Twentynine Palms
VICTIM(S): State of California
SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On Monday, August 11, 2025, at 8:12 p.m., deputies from the Morongo Basin Sheriff’s Station conducted a traffic enforcement stop on a grey Dodge 1500 for California Vehicle Code violations, at the intersection of Burmuda Avenue and Twentynine Palms Highway, in Twentynine Palms. Deputies contacted Drake Arthur Tyerman. During a records check it was discovered Tyerman had a suspended drivers license, in violation of CVC 14601.1(a).
Deputies located approximately 13 grams of suspected methamphetamine in Tyerman's possession. A criminal history records check was subsequently conducted, and Tyerman was found to have two prior convictions for HS 11377(a), possession of a controlled substance, and HS 11550(a), under the influence of a controlled substance. Under the convictions, Tyerman was in violation of HS 11395(b)(1), possession of a controlled substance with two prior felony convictions. Having the two prior convictions, the incident met California's Proposition 36 criteria. Tyerman was arrested and booked into the Morongo Basin Jail.
