Man Sleeping in a Park Found in Possession of Suspected Narcotics and Drug Paraphernalia

INCIDENT: HS11395(B)(1)- Treatment Mandated Felony Act/Misdemeanor Possession with Two Prior Convictions
LOCATION: Garcia Public Park, Rancho Cucamonga
SUSPECT(S): Barry Thomas Vance, Age 55, Transient of Rancho Cucamonga

SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On Tuesday, August 26, 2025, at approximately 2:50 a.m., Rancho Cucamonga deputies were proactively patrolling throughout the city, when they observed a blue Nissan Quest Van backed into a parking space at Garcia Public Park after hours. Deputies contacted the driver and sole occupant of the vehicle, who was later identified as Barry Thomas Vance. During the investigation, Vance was lying asleep in the vehicle with the passenger side door open. Upon contact, and in plain view, deputies observed a glass methamphetamine pipe in Vance’s immediate area. During a search of the vehicle, deputies located a clear plastic bag containing suspected methamphetamine and a prescription bottle not prescribed to Vance. The pills were later identified as Hydrocodone pills. Vance had several prior convictions for possession of methamphetamine, under the influence of methamphetamine and for possession of drug paraphernalia.
Vance was arrested and booked into the West Valley Detention Center for HS11395(B)(1)-Possession of Narcotics with Two Prior Convictions.
