SUMMARY: Arrest Made Under Proposition 36 - Controlled Substance Felony Enhancement - Twentynine Palms, California
On Monday, October 6, 2025, at approximately 12:36 a.m., Deputies O. Zavala and A. Penaloza from the San Bernardino County Sheriff's Department, Morongo Basin Station, were conducting proactive patrol near the intersection of Tamarisk Avenue and Cactus Drive in the City of Twentynine Palms. After deputies observed several vehicle code violations on a motorist's vehicle, they initiated a traffic stop and contacted the driver and sole occupant, Kevin Schermerhorn.
Through further investigation, deputies learned Schermerhorn had an extensive criminal history and had numerous narcotics-related arrests and convictions. Deputies conducted a search of of Schermerhorn's vehicle and located suspected methamphetamine.
Proposition 36, formally titled the Homelessness, Drug Addiction and Theft Reduction Act, which became effective December 18, 2024. California voters overwhelmingly ratified this law, reflecting the approved changed intended to address ongoing recidivism and addiction, that has negatively affected public safety of California residents.
Schermerhorn was subsequently arrested for HS 11395(b)(1), Possession of a Controlled Substance with Two or More Prior Convictions, a felony, under Proposition 36 criteria. He was booked into the Morongo Basin Jail.
