Rancho Cucamonga Resident Arrested for Being in Possession of a Controlled Substance

SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On October 5, 2025, at approximately 2:18 A.M., deputies were on active patrol and initiated a traffic stop on a Black Lexus for expired registration. Deputies contacted the driver and sole occupant of the vehicle, later identified as Mosese Uniseni Toki. During the investigation, deputies learned Toki was operating the vehicle on a suspended drivers license. During an inventory of the vehicle, deputies located zip loc bags that contained a substance consistent with suspected Methamphetamine, a weighing scale, and a glass pipe in the center console of the vehicle. The vehicle was towed and stored.
Toki was arrested and booked at West Valley Detention Center for HS 11395(B)(1)- Possession of a controlled substance with 2+ priors, HS11378-Possession of a controlled substance and VC14601.1(A)- Driving with a suspended license.
