SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On November 15, 2025, Armando Maese drove to the victim’s residence in Rancho Cucamonga, where he yelled at and struck the victim with various items. The victim had a Domestic Violence Restraining Order against Maese and was not sure how Maese found the residence. It was determined through investigation that Maese had been actively stalking the victim. Maese, who had a lengthy history of violent crimes, was sought after for the attack. Additionally, Maese was on parole at the time of the above crimes.
On November 24, 2025, deputies from the Rancho Cucamonga Multiple Enforcement Team conducted an apprehension operation in San Bernardino, in cooperation with the California Department of Corrections and Rehabilitation, and the Division of Adult Parole Operations. Maese was located and arrested. During the arrest process, Maese was found to be in possession of suspected methamphetamine.
Maese was arrested for PC 459 – Burglary, PC 646.9 – Stalking, PC 273.5 – Felony Spouse Abuse, PC 273.6 - Violation of a Domestic Violence Restraining Order, HS 11395(b) – Treatment-Mandated Felony, and PC 3056 – Parole Violation.
