SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 36 is applied:
On December 9, 2025, at 3:40 P.M., deputies responded to a theft at Target. Dylan Matthew Gonzalez took trading cards and a camera and concealed them on his person. Gonzalez then walked to the register and purchased three Hot Wheels toys but made no attempt to pay for the concealed items. Gonzalez exited Target and entered Hobby Lobby where deputies contacted him. Gonzalez was detained and the stolen property was recovered. During the investigation, Gonzalez possessed a small baggie of suspected methamphetamine. He was also found to have several prior theft and drug related convictions.
Gonzalez was arrested and booked at West Valley Detention Center for PC459.5(A)- Shoplifting and HS 11395-Possession of Narcotics/Paraphernalia with Two Prior Convictions.
