Vehicle Stop by Deputies Finds Man Found in Possession of Dangerous Drugs with two Prior Convictions

SUMMARY: Possession of Dangerous Drugs with Two Prior Convictions & Possession of a Controlled Substance for Sales
On January 15, 2026, while conducting proactive patrol in the unincorporated area of the Morongo Basin, Deputy L. Gonzalez of the Morongo Basin Station initiated a traffic enforcement stop on a vehicle near the intersection of Bonair Road and Twentynine Palms Highway, in Joshua Tree.
The stop was conducted due to multiple Vehicle Code violations. Deputy Gonzalez identified the driver as Allen Nerkins and the passenger as Daniel Rosamond.
During a consent search of Rosamond’s person, he was found to be in possession of fentanyl and drug paraphernalia. A records check revealed Rosamond had two or more prior convictions for Health and Safety Code violations. As a result, Rosamond was arrested for Health and Safety Code HS11395(b)(1) - Possession of a Controlled Substance with Prior Convictions, pursuant to Proposition 36.
The passenger, Nerkins, was found to be in possession of drug paraphernalia and was cite-released in the field for Health and Safety Code HS11364(a). Subsequent to Rosamond's arrest, he was transported and booked into the Morongo Basin Jail. During a secondary search, Dep. L. Gonzalez located a large quantity of methamphetamine and additional fentanyl, indicative of the possession for sales.
As a result, Rosamond was additionally charged for Health and Safety Code HS11378 - Possession of a Controlled Substance for Sale, and Penal Code PC4573 - Smuggling a Controlled Substance into a Jail Facility.
On November 5, 2024, California voters overwhelmingly passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for the increase in homelessness, recidivism, drug addiction and theft-related offenses. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance.
