MARION MAN CHARGED WITH FELONY DEATH BY DISTRIBUTION
A McDowell County Sheriff’s Office death investigation stemming from an incident last summer has concluded after toxic levels of illegal drugs were determined to be the cause of death.
The following is an update on the case:
On July 10, 2025 McDowell County Sheriff’s Office deputies responded to a residence in Nebo in reference to a cardiac arrest.
Upon arrival, deputies and McDowell County Emergency Services personnel on scene found 22-year-old Garrett Shepard deceased.
On February 11, 2026, MCSO Detective Michael Vaughn received the full autopsy report on Shephard by the North Carolina Office of the Chief Medical Examiner. The report revealed that Shephard had died from toxic levels of fentanyl and cocaine in his system. There were no signs of trauma or injury to the body.
An investigation by detectives determined that 46-year-old James Curtis Johnson of Marion was responsible for the drug distribution to Shephard.
“This case is a tragic reminder of the deadly consequences tied to fentanyl and illegal drug distribution,” said Chief Deputy Nathan Mace. “When individuals choose to sell or share these substances, they are putting lives at risk—and in this case, it cost a young man his life. We will continue to work tirelessly to hold those responsible accountable and seek justice for the victims and their families.”
Johnson was arrested on March 24, 2026, and charged with Felony Death by Distribution by Detective Michael Vaughn. He was issued a secured bond of $600,000.
