Proposition 36: Area Check Leads to Arrest of Petty Theft Suspect

DATE/TIME: Sunday, June 28, 2026, at 10:56 a.m.   

INCIDENT: PC 666.1(A)(1) – Petty Theft with Two Prior Theft Convictions

LOCATION: 12000 block of Amargosa Road, Victorville 

SUSPECT(S): Luis Padilla, 39-year-old, Resident of Victorville
 
SUMMARY: On November 5, 2024, California voters passed Proposition 36 titled “The Homelessness, Drug Addiction and Theft Reduction Act.” The proposition took effect on December 18, 2024, and reforms multiple laws from Proposition 47, which have been responsible for increasing homelessness, drug addiction and theft. Proposition 36 includes several new Penal and Health and Safety Codes that deputies will be able to apply during arrests when appropriate. These new charges can carry enhanced sentencing, as well as prevent offenders from being cite released prior to their court appearance. The following is an arrest where Proposition 6 is applied:

On Sunday, June 28, 2026, at approximately 10:56 a.m., deputies from the Victorville Police Station responded to a theft report at the G&M Gas Station located in the 12000 block of Amargosa Road. 

The investigation revealed Luis Padilla entered the business, walked behind the sales counter, and took two packs of Marlboro cigarettes and left without paying. Padilla left the area before deputies arrived, but was located in a nearby parking lot during an area check. 

Luis Padilla was arrested and booked at the High Desert Detention Center in Adelanto, for P.C. 666.1(A)(1) – Petty Theft with Two prior Theft Convictions.
