UCI Police Department has received a report of an alleged sexual assault that occurred at an unknown time between Saturday evening, December 6, 2014, and Sunday morning, December 7, 2014, inside a Mesa Court residence hall room. The victim, a student, reported she was sexually assaulted while incapacitated.
The suspect, known to the victim and a student at UCI, is described as a white male with a dark complexion, 18 years old, 5’10”, medium build with short black hair and dark brown eyes.
SEXUAL ASSAULT INFORMATION
Sexual assault occurs when physical sexual activity is engaged in without the consent of the other person. Consent is an affirmative, unambiguous, and conscious decision by each participant to engage in mutually agreed-upon sexual activity. Consent cannot be given when a person is incapacitated. Silence does not equal consent. Consent must be ongoing throughout a sexual encounter and can be revoked at any time. Once consent is withdrawn, the sexual activity must stop immediately.
No action or inaction by a crime survivor makes that person responsible for his or her victimization. Perpetrators are responsible for crimes and their effects. It is a crime to intentionally touch someone against his or her will, regardless of the situation.
