New Fireworks Law, Safety & Courtesy

Dear Residents,

Last evening, officers from the UMTPD responded to a total of ten complaints of firework activity throughout the township. Throughout the upcoming weekend, we expect there to be more complaints of this type of activity, so we thought it may be appropriate to remind residents about the new law regarding fireworks (and hopefully avoid these types of problems).

All Police Departments in Lehigh County were given specific guidance regarding the new law by the Lehigh County District Attorney.

In accordance with the Fireworks Act, a person does not need a permit for consumer fireworks, ground and hand-held sparkling devices, novelties, or toy caps. As such, the following is a non-exhaustive list of examples allowed without a permit: aerial devices (sky rockets, bottle rockets, roman candles, mine and shell devices containing no more than 60 grams of total chemical composition); audible ground devices (firecrackers, chasers); ground and hand-held sparkling devices (sparklers, ground spinner, cylindrical fountain); novelties (party popper, snapper, smoke devices); and toy caps (plastic and paper caps for toy pistols).

The following are prohibited without a permit: Aerial Shells (containing more than 60 grams of pyrotechnic compositions); Salutes (containing more than two grains or 130 milligrams of explosive materials); and other firework devices "that exceed the limits of explosive materials” for classification as consumer fireworks and are classified as fireworks.

Residents should be aware that the law prohibits citizens from igniting fireworks while under the influence of alcohol, a controlled substance, or another drug. In addition, consumer fireworks may not be ignited or discharged within 150 feet of an occupied structure.

Violation(s) of the Fireworks Act is a summary offense that involves a fine of up to $100.

UMTPD officers will increase neighborhood patrols throughout the weekend and will monitor for violations of this law.

Lastly, please remember to use good judgement when using fireworks and handle them safely. Consumer fireworks are the cause of many severe injuries (and fatalities) throughout the United States every year. We have received complaints of fireworks being ignited at late hours, as well as complaints of trash and paper remnants being scattered throughout yards/streets in the township. Courtesy among neighbors goes a long way and will potentially help avoid problems that may eventually involve police intervention.
