Suspect charged after breaking into a residence armed with a gun

On October 28th at 3:55 pm, officers responded to an apartment building on the 1600 block of 62nd Street on a report of a disturbance involving a man who was armed with a gun and had broken out an apartment window.

After officers arrived, the suspect came out of an apartment armed with a handgun.  Officers directed the suspect to put the handgun down and were then able to safely take him into custody.

While investigating the incident, officers learned from the victim that the suspect (an old acquaintance) had come by the apartment to ask for a favor.  When the victim told the suspect to leave, the suspect left the apartment only to return about 15 minutes later to again confront the victim.  When the victim stopped speaking with the suspect, the suspect broke the apartment’s window and climbed inside—armed with a handgun.  The victim locked himself inside his bedroom and called for police.  The suspect then started banging on the bedroom’s locked door.  Fearing that the suspect might get through the door, the victim climbed out of the bedroom’s window and jumped to the ground level—where officers were outside.

On October 29th, the Alameda County District Attorney’s Office charged the suspect (a 33-year-old Berkeley man) with PC 459—Burglary, PC 422(a)—Criminal Threats, PC 25400(a)—Possession of concealed firearm as well as several criminal enhancements.
