ARRAIGNMENT/BAIL STATUS: Dean was processed at Amsterdam Police headquarters where he was arraigned and released to appear at a later date.
INCIDENT NARRATIVE: On January 9th 2023 Amsterdam Police were notified by the NYS sex offender registry that sex offender, James A. Dean failed to complete the annual verification process as required by law. An Amsterdam Police detective attempted to make contact with Dean at the Jay Street residence listed on the sex offender registry. The detective attempted several times to make contact with Dean at the residence with negative results.
Responding officers and detectives observed that there were several dogs left inside the residence which appeared to have been abandoned. This investigation then took on two different goals one being locating the absconded sex offender James A. Dean as well as rescuing and evaluating the abandoned animals. Amsterdam PD animal control and patrol officers then made entry to secure and remove the dogs from inside the property. Upon entry into the residence officers located five dogs in total. The residence did not have power or heat. Inside there were several garbage cans full of dog feces. Two dogs were located on the first floor one in a kennel another locked in a separate room. Three additional dogs were located in the basement of the residence.
Amsterdam Animal Control Officer Gina Kline assisted in removing the dogs and transported them to the Montgomery County SPCA.
The suspect James A. Dean later contacted Amsterdam animal control and came to police headquarters for an interview. At the conclusion of the interview it was determined that Dean did not reside at the residence that he listed on the Sex Offender Registry. Dean is currently a level 2 sex offender and is required to make notification of a change in address and to complete an annual verification per NYS the sex offender registry. Dean was then placed under arrest for failing to complete annual verification, failure to report a change of address and obstructing governmental administration. He was then processed and arraigned in Amsterdam City Court by the Honorable William J. Mycek and released to return a later date.
On January 31st 2023 after medical evaluations of each of the dogs were performed the additional charges of Cruelty to Animals, failure to vaccinate, unlicensed dog, and unsanitary living conditions for a dog were added.
While there was probable cause for this arrest, all persons are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
