ARRAIGNMENT/BAIL STATUS: Delacruz was arrested and transported to Amsterdam Police Headquarters where he was processed and arraigned in front of the Honorable Judge Lisa W. Lorman and remanded to the custody of the Montgomery County Correctional Facility without bail.
INCIDENT NARRATIVE: On March 31st at approximately 1:00 a.m. Amsterdam Police officers on routine patrol observed a male crouched down in the middle of Guy Park Avenue in the City of Amsterdam. Officers observed the male who was later identified as Christopher Delacruz drop a bag and stumble in the street where he was observed obstructing traffic nearly being struck by a passing car. Officers then conducted a field interview of Delacruz to check his welfare. During the field interview Delacruz was at first cooperative with officers until a short time later he attempted to flee the interview by running on foot. Patrol officers gave chase and quickly apprehended Delacruz where he began pulling away from officers and tried several times to reach into his hooded sweatshirt pocket. Officers were able to detain Delacruz in handcuffs after a brief struggle. A search of Delacruz revealed a loaded .40 caliber Taurus handgun in his hooded sweatshirt pocket. The weapon was examined further and observed to have its serial number filed off. Delacruz was then transported to Amsterdam Police HQ for processing where he was processed and held pending arraignment.
While there was probable cause for this arrest, all persons are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
