Sheriff's Department Clarifies Number of In-Custody Deaths at Correctional Facilities in San Bernardino County

INCIDENT: In-Custody Deaths in San Bernardino County Correctional Facilities
SUMMARY:
We recognize the death of a person who is incarcerated is extremely impactful to their family and friends and affect others who are incarcerated as well as our staff. The safety and security of all those who are incarcerated in the San Bernardino County correctional facilities are a top priority.
An advocate group posted on social media platforms that the San Bernardino County Correctional facilities have 20 deaths of incarcerated persons this year. It is unknown where they received their information, however they are incorrect and have exaggerated their numbers.
To date, there have been 10 in custody deaths (ICD) in 2024 throughout our four correctional facilities which have a daily population of approximately 4,700 inmates and have booked 49,208 arrestees. Of those deaths, six succumbed while under medical care at local hospitals. The remaining four were in were within the facilities. The Detention and Corrections Bureau follows the Board of State Community and Corrections (BSCC) ICD investigation guidelines. This process includes collaborative reviews within a week of an incident, involving input from homicide investigators, medical and mental health staff, and facility administration. The department also conducts an internal review to determine if the actions of the personnel involved were within policy and whether additional policies, training or equipment is needed to assist with the safety and security of those who are incarcerated.
Since implementation of Assembly Bill (AB) 109 prison realignment requirements, in 2011, our county has experienced inmate populations with increased medical and mental health needs that are housed in our jail facilities. As a result, we have greatly improved medical and mental health services provided to the inmate population. Our proactive approach has been supported by a federal court stipulation that has removed medical oversight by the Prison Law Office (PLO), further proving the dedication we have toward improving medical and mental health care within our jail facilities.
California law requires that when an individual under custody passes away, the agency with jurisdiction over the local correctional facility with custodial responsibility for the person at the time of their death must post specific information on its internet website. Additionally, Penal Code section 832.10 requires that any record relating to an investigation of an in-custody death be made available for public inspection. These records must be thoroughly reviewed to ensure confidential information is redacted.
